By booking a tour with Take The Wheel Baja, you agree to the following terms and conditions:

1. Booking Requirements

• All participants must be 18 years or older to drive with a valid driver’s license.
• Passengers must be at least 9 years old.
• A signed waiver of liability is required for all participants prior to tour departure.
• A refundable damage deposit or credit card hold may be required at check-in.

2. Cancellations & Refunds

• Cancellations made 48 hours or more before the scheduled tour time are eligible for a full refund.
• Cancellations made within 48 hours of the tour are non-refundable.
• No-shows or late arrivals that miss the tour will be charged in full.
• Tours may be rescheduled due to weather or safety concerns at the discretion of Take The Wheel Baja.

3. Liability & Risk

• All participants acknowledge the inherent risks of off-road vehicle use, including but not limited to terrain hazards, rollover risk, wildlife, or weather conditions.
• Take The Wheel Baja, its guides, owners, or affiliates are not responsible for any personal injury, loss, or property damage resulting from participation in the tour.
• Each participant assumes full responsibility for their actions while operating the vehicle.

4. Vehicle Damage

• Drivers are financially responsible for any damage caused to the vehicle or property due to negligent, reckless, or intentional behavior.
• In the event of damage, repair or replacement costs will be charged to the driver’s card on file or deducted from the deposit.
• Normal wear (dust, light scuffing) is accepted, but excessive abuse, deep scratches, water damage, or misuse will incur charges.

5. Tour Guidelines & Safety

• All participants must follow the guide’s instructions at all times.
• No alcohol, drugs, or impaired driving is permitted before or during the tour.
• Helmets, safety belts, and other protective gear must be worn as instructed.
• Disregard for safety or aggressive behavior may result in termination of the tour without refund.

6. Weather & Force Majeure

• Tours operate in most weather conditions. However, Take The Wheel Baja reserves the right to cancel or postpone tours in cases of extreme weather, mechanical failure, or natural disaster.
• If a tour is canceled by us, you will receive a full refund or credit for a future date.

7. Media Release

• By participating in the tour, you grant Take The Wheel Baja permission to use any photos or videos taken during the experience for marketing or promotional purposes, unless otherwise requested in writing prior to the tour.

8. Jurisdiction & Legal Venue

• All disputes arising from participation in a tour shall be governed by the laws of Baja California Sur, Mexico.
